Foreclosures are scary, but they’re not uncommon. About one out of every 200 homes in the US is foreclosed on.

When Is Foreclosure Prevention Too Late?

The last opportunity to stop a foreclosure is right before the property is sold at a sale or auction or before any mandated deadlines before the sale. Until that point, you still have a chance at last-minute foreclosure prevention.

Usually, the foreclosure process begins after several missed payments. The lender sends a notice of default and a set period to get up to date. If this period has passed, the lender issues another notice that they will foreclose.

However, even this isn’t too late.

How To Stop a Foreclosure

If you have some leeway, you can choose a last-chance foreclosure stop.

Bankruptcy

Filing for bankruptcy puts an automatic stop to any foreclosure activity. The bank will be prohibited from proceeding with foreclosure. The lender can try to lift the stay by filing a court motion. 

During this delay, you can work to find other solutions.

Loan Modification

Loan modifications can be time-consuming and require the lender to approve. This modification allows you to change the mortgage terms so the payments are more affordable.

Mortgage Forbearance

If a mortgage forbearance is granted, you receive 180 days without payments, with the possibility of an extension. This does not eliminate any owed payments.

Lease or Assumption Option

If you take a lease option, rent payments can go toward the delinquent payments. Alternatively, a new person can assume the loan and release the homeowner from liability.

Work on the Loan

In this scenario, you can reinstate the loan. You’ll need to pay all delinquent mortgage payments and other fees until you’ve paid off the full balance of the mortgage.

Sell the Property

Selling the property is sometimes the best option. The lender must approve a short sale, which is when the property sells for less than the mortgage balance.

Agree to a Repayment Plan

You may be able to agree on a repayment plan with the lender, allowing you to pay off the missing payments over time.
