Understanding the Seven-Year Rule

Under the federal Fair Credit Reporting Act (FCRA), a foreclosure remains on your credit report for seven years. The seven-year clock starts on the date of the first missed mortgage payment, creating the foreclosure delinquency, not on the date of the sale.

For example, if you missed your first payment in March 2024, the permitted reporting period runs through March 2031. The date of first delinquency serves as the anchor point for all credit reporting.

How Foreclosure Appears on Your Credit Report

A foreclosure does not appear as a single entry on your report. You’ll see the progression across your mortgage history, with 30, 60, 90, and 120+ days of delinquency noted. Of course, each subsequent mark further reduces your score.

Once foreclosure proceedings begin, additional notations appear showing “foreclosure started” or “foreclosed.” After a foreclosure sale, the status may read “foreclosure completed.” These entries do not restart the seven-year clock.

Homeowners with previously good credit typically see their scores fall by 100 to 160 points. Those with previously damaged credit may see a smaller drop, but the impact is still relatively severe. In addition to your prior credit score, your mortgage history before delinquency and the status of other accounts factor into the impact on your score. 

When Credit Reporting Errors Occur

As we’ve shown, foreclosures cannot legally stay on your credit report longer than seven years. However, errors occur, with common mistakes including listing the wrong date of first delinquency or failing to note a foreclosure after a bankruptcy discharge. These errors violate the FCRA, and you can dispute them.

Understanding How Foreclosure Proceeds in Ohio

Ohio follows a judicial process in mandating the phases of foreclosure. The first phase begins with missed payments, followed by delinquency. The largest drop in your credit score often occurs before court action begins. Formal filing follows, and then the process proceeds to judgment and, finally, to the sale. 

How Bankruptcy Changes the Timeline

Filing for bankruptcy does not reset the foreclosure reporting clock. 

Under Chapter 7 bankruptcy, the foreclosure can still appear for seven years, but any deficiency balance must be shown as “discharged.” A Chapter 7 case remains on your report for 10 years. 

Chapter 13 bankruptcy may help you avoid or delay foreclosure and stays on your credit report for seven years.
